Sanktionen gegen Personal des Internationalen Strafgerichtshofs: Von Trump verhängt, von Biden aufgehoben

Die Sanktionen waren Gegenstand der Executive Order 13928 vom 11. Juni 2020 "Blocking Property of Certain Persons Associated With the International Criminal Court", die im Zusammenhang mit dem Afghanistan-Krieg stand.

Sie wurden durch die Executive Order 14022 vom 1. April  2021 "Termination of Emergency With Respect to the International Criminal Court" aufgehoben.

Es heißt darin:

"I, JOSEPH R. BIDEN JR., President of the United States of America, find that, although the United States continues to object to the International Criminal Court’s (ICC) assertions of jurisdiction over personnel of such non-States Parties as the United States and its allies absent their consent or referral by the United Nations Security Council and will vigorously protect current and former United States personnel from any attempts to exercise such jurisdiction, the threat and imposition of financial sanctions against the Court, its personnel, and those who assist it are not an effective or appropriate strategy for addressing the United States’ concerns with the ICC."

Auch Russland ist nicht Vertragsstaat des Römischen Status des Internationalen Strafgerichtshofs. Auf den Erlass eines Internationalen Haftbefehls gegen Putin im Zusammenhang mit dem Ukraine-Krieg reagierte Biden gegenüber der Presse am 17.3.2023 folgendermaßen:

Q Could you give us your reaction to the International Criminal Court issuing an arrest warrant for Vladimir Putin?

THE PRESIDENT: Well, I think it’s justified. But the question is, it’s not recognized internationally by us either. But I think it makes a very strong point.

Der Internationale Strafgerichtshof hat seine territoriale Zuständigkeit für Gaza und das Westjordanland einschließlich Ost-Jerusalem in einer Entscheidung vom 5.2.2021 bejaht. Er ist nicht nur zuständig, wenn Staatsangehörige eines Vertragsstaates seiner Gerichtsbarkeit unterliegende Verbrechen begangen haben, sondern auch - unabhängig von der Staatsangehörigkeit des Täters - , wenn solche Verbrechen auf dem Gebiet eines Vertragsstaates begangen wurden.
