Die Gerichtsbarkeit des Internationalen Strafgerichtsbarkeit erstreckt sich gemäß Art. 5 des Römischen Statuts auf das Verbrechen des Völkermordes, Verbrechen gegen die Menschlichkeit, Kriegsverbrechen und das Verbrechen der Aggression. Was diese Begriffe im Sinne des Status bedeuten, wird in den Art. 6-8bis definiert.

Art. 6 des Römischen Statuts lautet in der englischen Version (Deutsch ist keine der Vertragssprachen):

"Genocide

For the purpose of this Statute, "genocide" means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:

(a) Killing members of the group;

(b) Causing serious bodily or mental harm to members of the group;

(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;

(d) Imposing measures intended to prevent births within the group;

(e) Forcibly transferring children of the group to another group."

Zu den Verbrechen gegen die Menschlichkeit zählt Art. 7 des Römischen Statuts auch das Verbrechen der Apartheid. Art. 7 Abs. 2 Buchst. h definiert dieses Verbrechen folgendermaßen:

"The crime of apartheid" means inhumane acts of a character similar to those referred to in paragraph 1, committed in the context of an institutionalized regime of systematic oppression and domination by one racial group over any other racial group or groups and committed with the intention of maintaining that regime".
