Generalversammlung der Vereinten Nationen, Resolution A/RES/77/247 v. 30.12.2022, Anforderung eines Gutachtens des Internationalen Gerichtshof betr. die rechtlichen Konsequenzen, die sich aus den Politiken und dem Verhalten Israels im besetzten palästinensischen Gebiet einschließlich Jerusalem ergeben

Ziff. 18 der Resolution lautet:

"18. Decides, in accordance with Article 96 of the Charter of the United Nations, to request the International Court of Justice, pursuant to Article 6 5 of the Statute of the Court, to render an advisory opinion on the following questions, considering the rules and principles of international law, including the Charter of the United Nations, international humanitarian law, international human rights law, relevant resolutions of the Security Council, the General Assembly and the Human Rights Council, and the advisory opinion of the Court of 9 July 2004:
(a) What are the legal consequences arising from the ongoing violation by Israel of the right of the Palestinian people to self-determination, from its prolonged occupation, settlement and annexation of the Palestinian territory occupied since 1967, including measures aimed at altering the demographic composition, character and status of the Holy City of Jerusalem, and from its adoption of related discriminatory legislation and measures?
(b) How do the policies and practices of Israel referred to in paragraph 18 (a) above affect the legal status of the occupation, and what are the legal consequences that arise for all States and the United Nations from this status?"

Ab dem 19. Februar 2024 wird hierzu eine öffentlichen Anhörung stattfinden (Pressemitteilung des Internationalen Gerichtshofs v. 23.10.2023).

Die Unabhängige Internationale Untersuchungskommission für die besetzten palästinensischen Gebiete, einschließlich Ostjerusalem, und Israel hatte der Generalversammlung die Anrufung des Internationalen Gerichtshofs dringend empfohlen. In ihrer Stellungnahme zu dem Beschluss der Generalversammlung heißt es:

"The Commission found in its first report that the continued occupation by Israel of Palestinian territory and discrimination against Palestinians were the key root causes of the recurrent tensions, instability and protraction of conflict in the region. The Commission’s second report to the General Assembly, based on its conclusion about the illegality of such an occupation, made the core recommendation for an advisory opinion from the International Court of Justice. 

The Commission considers that a definitive clarification of the legal consequences of Israel’s refusal to end the occupation, and what the obligation of third parties to ensure respect for international law are, will be crucial to member States and the UN in considering what further measures should be adopted to ensure full compliance with international law."
